Free Bernie Madoff


Here is why I strongly oppose the prosecution of Bernie Madoff:

We must instead make it more difficult for future potential criminals to defraud Americans. Let us move forward rather than backward.

Plus we need to fix the economy.

Stop the witch-hunt.

Let us at least peruse his books first. Let us see who has aided him in the past. Let us see what forces and powers were necessary to pull off the single biggest scam in the history of the world markets?

Or, if you persist in this don't look back methodology, let us declare an amnesty for 70% of those imprisoned by the state and federal governmental units.

After all, we had to do a lot of looking back, so to speak, to convict them. Didn't we?

Yeah! Better yet, let's throw open the prisons and turn loose all the inmates, including gangbangers and murderers. Let Madoff be a precedent for the "past-tense defense": If a crime is more than an hour old, hey... it's all in the past. Let's move on. Your daughter was raped? Your friend was murdered by a serial killer? Chin up, spud! There's always tomorrow.

All Madoff did was bleed white a bunch of suckers to the tune of billions. Stop the dang witch-hunt, fascists!

Um...ok? Let's just for the sake of boredom go with your suggestion. How do you intend to make it more difficult? Make more laws that future criminals will ignore? Because there are no consequences?

I can just imagine the future crooks:

"You honor, I request that my criminal client be set free. There is a legal precedent in US vs Madoff..."

Very true DD. I love to state the obvious anyway. As for clearthinker, you know he kind of grows on you. Yeah, he is kind of dark in an Eeyore kind of way and can be very pompous (for lack of a better word) but he really is very technically intelligent and does have a lot to offer if you can get past the "I am brilliant, you are all just ignorant peons" kind of stuff. I don't think he really thinks that, I think he just comes off that way.

Now that you mention it M20, I think so too. Probably in reference to Obama's "we need to look forward" when questioned about war crimes investigations. I wish people would just let the poor guy get sworn in first. Geez.

TS, sounds like you listened to Talk of the Nation today. I was feeling some seriously violent feelings listening to Charles Fried make the case that history will be the judge of the Bush administration so there is no need to prosecute the war crimes.

I've been going back and forth in my mind about it because I do think there is validity in the point that we've got a lot of problems to solve and prosecutions would be a drain on our financial and emotional health as a country.

However, the argument that if we prosecute, the republicans will actively look for things to prosecute the next time they take office is about the stupidest thing I've ever heard.

The second stupidest thing I ever heard is Fried comparing prosecution of the Bush administration to the trumped-up prosecutions of political enemies in countries like Zimbabwe.

I still go back and forth. I want them to pay, but I also want to never hear about or from them again.

Argument I hate is we can't now go after people for crimes associated with death in large quantities because some yahoos tried to catch Clinton and ended up trying to do it with him lying about sex in a lawsuit without merit.

Y'know, given the fact that the Clinton Impeachment always seemed like a lynching simply looking for an excuse to ready the gallows, I can't but wonder sometimes if it wasn't all about making the American people sick of it all and thus provide a free ride for the criminals who would follow.

As I see it, we are not afforded a choice as to whether or not to prosecute war crimes. It is our responsibility and we must surely have the courage and will to eliminate this precedent, no? What principles will we stand for if not for Freedom and Liberty?

Yup. It must be done! All those who worry Obama has other things on their mind should remember, he's the "executive." It's "judicial" that can take care of this. And must! It may all percolate through years and years of investigation that we may not be privy to, but that may not mean it's not happening.

You are absolutely right TheraP. These are the same people who will argue for "law and order" when it comes to lethal injection for kid criminals or prison for any crime committed while being black.

I would argue that I feel far more threatened by the Madaoff's and bush/Cheney cabal than nearly any of the other criminal elements. To suggest we simply ignore them and "move forward" is insulting and absolutely immoral.
