Italian Bloggers Strike Over "Offensive" Comments Law: Dick Day Goes Into Hiding

Would God sue Dick Day for defamation of character? LisaB for collaborating with said blasphemer? Murry for misquoting Bo Obama? It could happen in Italy:
This week in Rome, bloggers and activists wore gags to protest a proposed law that could impose heavy fines on bloggers who don't correct "offensive" comments within 48 hours."48 hours"! it takes Day longer then that to wake up from a bender. And, how could he smoke with a gag?! (Knowing Day he would find a way, especially if it were made of hemp - say hey Billy Mays...) But I digress...what's this lovely law all about?:
"$18,000"! that's more then Day spends a week on booze and butts. This all begs the question are Italians anti-Day rights or...:...the law would force bloggers to edit any post denounced to the government as defamatory. If the blogger refused, the denouncing citizen could sue for as much as $18,000.
"Scorza, a lawyer,"how did he get one name? I thought that was resirved for like, Madona. I digress, so who speaks out for the oppressed blogger:"They are trying to reduce the number of bloggers in Italy," said Scorza, a lawyer and expert in digital civil rights. He said the internet has given Italians the tools to question their elected representatives.
One such Italian, the comedian-turned-blogger Beppe Grillo, has used the web to expose the Italian Parliament's inability to act on crucial issues such as conflict of interest, corruption and the environment."Beppe Grillo," what kid of a name is that for a comedian, ours have real names like Patrick J. Buchanan, and Rush Limbaugh, now those are comedians!
So who is this funny man?:
Every year, Grillo organizes a popular event called "V-Day," which promotes active citizenship, and the use of the web as a news source. Recently, Grillo's popularity won him an online election as the next secretary of the Italian Democratic Party (PD). The party, however, refused his candidacy.Sounds like, Michael Steele, but I digress. Surely, someone else speaks for the destitute, despotized, and subjugated bloggers:
Antonio Palmieri, a Parliament member from Berlusconi's People of Freedom Party (PdL), said the Alfano law aims at stopping bloggers from abusing the freedom of the internet.My kind of guy... Wait a gosh darn minute doesn't Berlusconi like own Italy?:"How would you feel if you were anonymously insulted on the internet every day?" he said.
In a country where the prime minister owns the three largest commercial TV channels, the biggest publishing house, a leading advertising agency, and -- as head of state -- oversees Italian public television...Wow a trifecta plus-one of power and control with just one righteous dude, we needed two, Rupert Murdoch and GW Bush. But I digress... Just how far will this law go?:
Palmieri defended the "Alfano" proposal but also said it was written as an emotional reaction. He is working to improve the language of the proposal by clarifying what kinds of blogs and web sites should be liable. So, nu, what brought this all on?:
In 2007, a YouTube video of a recorded phone call between then-opposition leader Silvio Berlusconi and a former RAI director exposed Berlusconi to public scrutiny. In the call, Berlusconi asked the RAI director to hire two women as a favor for a senator of the majority. Berlusconi said explicitly that he expected the senator to return the favor by helping him regain a Parliamentary majority.
The nerve of some people. What are you going to tell me next, Berlusconi is having an affair with an 18-year-old?
Recently, now-Prime Minister Berlusconi has been under heavy public scrutiny for an ambiguous relationship with an 18-year-old aspiring TV star. Within days, the internet was saturated with satirical renditions of the alleged relationship via print, audio photo and video.Wow, just like any old Republican. Hey, it's Italy, it's expected there dudes.
Could it happen here? Well. if the economy doesn't start creating jobs. Wall Street pays themselves billions of our dollars in bonuses. Heath care reform breaks a tailbone. And, Bo Obama pees on the Presidential Seal (arf), we could have another Bush in the White House. If I were Josh Marshal I'd get misanthropic, itinerant blogger insurance just in case.
Now back to Dick Day you, Sir, on multiple occlusions, called me a "feline canine." The nerve of you to offend me in that way! You can expect a call from Murry's lawyer!
PS I know what you are thinking, we have a Constitution, a First Amendment, Keith Olbermann. Let me me put those thoughts to rest with two of the scariest words in the English language...Dick Cheney.

So I'm 8 and living in Chi Town. Every Saturday when the Cubs are in town (else the Sox)my friend's father takes us to the game. We get there early (a habit to this day)and always sit in the first row of the bleachers. Pretty cool, eh. Except for one problem, people were always booing and yelling terrible things at me. Could it of been my Dodger hat?

Just to address a couple of issues here:
I haz faith in the Italian bloggers. There is nothing worse than a blogger scornful of a law. There are many ways to evade the Internet policios. In a country that can't keep the traffic on its roads under control, never mind it's Parliament, I think the policios will be chasing each other while the bloggers blog about it all in glee.
However, this is all said with the caveat that one of the bloggers is not the alleged defamer, DickDay. I say alleged because even though I saw the alleged defamation with my own two eyes, he has not yet been convicted in a defamation court of no-law.
But if one of the bloggers is the alleged defamer, DickDay, the gig will be up in less than an hour. I say this because I know with certainty that it was only today that the DickDay discovered his address book on the computer.
Thus, I think it's fair to say that the odds of DickDay successfully blogging while hiding on the Internet are so faint that not even Goldman Sachs would try to securitize them.
Tell Murry to make that phone call. Calling a respectable dog person a "feline canine" really should be against the law, if it already isn't.
Hope I didn't digress too much. It's so hard to tell these days.

As for Italy, well......Mussolini's apples haven't fallen far from the tree, have they? Oy.

Sad thing is, they can probably enforce it. I was there a few months ago and used the internet in my hotel. Before I was allowed to use their computer, they had me sign a waiver stating that I would not hold them responsible for government interception of my internet use. So much for the eternal city.

While from what little I've read it seems the Italian law is ill conceived defamation of character on the internet is a serious concern. As is the stalking that sometimes accompanies it. If bloggers and news sites with a blogging component are to be our new way of getting news there needs to be some standards. Anonimity is not a defense for libel. Sites, especially those like TPM, do have some responsibility to maintain certain standards.

I don't see how bloggers can be held accountable for expressing their outrage at our elected officials.
If bloggers, who are citizens expressing themselves, are to be held accountable then there are others who must necessarily be ahead of us in accountability line.
If not, screw them.

Let's face it! Against whom will these laws be enacted? Politicians make deceitful statement and defame people all the time. When is Ruish going to be jailed, or O'Reilly or Hannity for what they spew on the airwaves? When those batards go down, we can consider censoring the web. Meanwhile, stalkers should all be tried and sent to jail. Cyber or otherwise.

You know, now that I think about it, No censorship on the Web! If someone does not like a post, they have an opportunity to post a reply. Words for words. It's a free web! Maybe we just need a law that sites MUST permit responses from those mentioned ot mreain posted, if they post about someone, but ONLY from the one about whom a post is made, so as not to require every opinion to stand adn take up space. Just the One must remain posted.
