Bush Saves Holder!


Most useful outcome of Bush's on-again/off-again pardon of Toussie?  Senate Republicans will now not be able to torture Eric Holder over Marc Rich pardon shenanigans 8 years ago.  Way to go, Bushie!

You know this was brought up by somebody earlier this week. But I am currently watching my favorite film of all time, Revenge of the Pink Panther.
Its primary motiff, so to speak, is that idiots
can be WMDs all on their own and through serendipity, do good once in awhile.

Nah, they'll spin it so it comes out that Bush rescinded his pardon and Clinton didn't (because Holder didn't advise him to). That being said, I think cooler heads will prevail and Holder will be confirmed.

I thought the reason Rich had been pardoned was because he made an agreement with the DA and returned all the money he had taken in return for coming back to the US.

What about Holder's war on medical marijuana? It is mind-boggling to hold to the federal government's stance, against copious evidence, that there is no medical benefit. It is crazy to raid dispensaries where the state and local governments are ok with it.
Prostitution is legal under Nevada state law; should the feds go in and raid the brothels?
Besides the harm to the patients, it is in some ways consistent with the Bushie tactic of proclaiming what reality is based on what they want it to be.
Does anyone think this will be raised in Holder's confirmation hearing?

I agree it could damp some of the spin. Thing is, Holder never gave a positive recommendation for a Rich pardon (neutral, leaning favorable, is how I understand he gave a last minute phone advisory) because it was never really his job. He just happened to have had various contacts as Rich was trying to work out a deal, but the prosecutors wouldn't play ball with Rich's atty.

If so, it's Much Ado About Nothing.

If Toussie challenges the "unpardon" at the Supreme Court, the most useful outcome could be that applicants have to stop using the backdoor to request pardons.

While Title 28 of the federal regulations code spells out the process for pardons, the president himself is not bound by those rules. This has led to some interpretation that if an applicant can get access to the president and skirt that process, (s)he can still get a pardon. Rich and Toussie both went the backdoor route and avoided the procedures outlined in Title 28.

But can they? 28 C.F.R. §§ 1.1 states: A person seeking executive clemency by pardon, reprieve, commutation of sentence, or remission of fine shall execute a formal petition. The petition shall be addressed to the President of the United States and shall be submitted to the Pardon Attorney, Department of Justice, Washington, DC 20530, except for petitions relating to military offenses.

The rule seems pretty straightforward. If you want a pardon, you will submit a petition to the Pardon Attorney (with the one expection relating to military offenses). It doesn't say, "You can either submit a petition to the Pardon Attorney or use clout and contacts if you have them to reach the president directly." Only a choice few people seeking pardons would have the clout and contacts to be able to do that.

While the president may not be bound by the rule, it does seem to obligate the applicant. I would hope that if Toussie does take his unpardon to the Supreme Court, they would tell him that his application was invalid because he did not follow the rules of procedure when submitting his petition in the first place. Otherwise, the loophole will allow those with direct access an unfair advantage, and one that I doubt the Founding Fathers ever intended.
