Double Standard for Madoff

"Madoff's wife, Ruth, agreed to give up homes in Montauk, New York, and Palm Beach, Florida, if her husband flees."
Why haven't these homes been seized?
He has admitted to illegal action. These homes are obviously the product of criminal behavior if this had been an arrest for a single joint the family would be on the street.
Hell in the case of drugs, and I believe according to an executive order interpreting the "patriot" act, an arrest is not even needed just suspicion.
So here we have a rich individual who has admitted to a long running criminal activity still being able to use the fruits of his crime to try to thwart the justice system.
Seize all his assets, make the lawyers "prove" that the money they are getting is "clean" before they can represent him and throw him in jail with out bail until the trail is over.
This is what they do for "suspected" petty criminals, "suspected" drug offenses, "suspected" terrorist sympathizers.
Why not for a self confessed con man?

They want him to cooperate in order to get as much of the money back as possible. Shackles and chains won't help, but I am sure he is not looking forward to a future of luxury.
