Well if the GOP is for it, then I am against it. It will be interesting to see how the Court comes down, if it gets that far.
A five-man majority in 2007 upheld McCain-Feingold but really weakened it.
The case was FEC v Wisconsin Right to Life The majority was Scalia Thomas Kennedy Alito and CJ Roberts. I feel that that majority would hold together if the new suit presents any federal issues not resolved in the last case AND they decided to grant cert.
McCain-Feingold is a weird law, constitutionally speaking. Liberals and conservatives are both split by the issues it raises on restricting speech.
