Obama Fiddles While the Constitution Burns

The mainstream media love showmanship more than they love anything except low corporate taxes, so it isn't much of a surprise that the networks and old media outlets like the Washington Post are on exactly the same page as the unprincipled showman Barack Obama.

Forget about those "FISA Follies," says the Washington Post. Don't worry about what the Senator Chris Dodd called "abandonment of the rule of law" in a great speech announcing his filibuster of the FISA bill.

"Mr. Obama nailed it the other day when he explained his new position -- "that the issue of the phone companies per se is not one that overrides the security interests of the American people," says the Washington Post. And why is Mr. Obama so right about the FISA bill?

Because "no one can claim with certainty that his or her communications were monitored," says the Washington Post.

Harharharhar!!! Those fascist clowns at the Washington Post are incredibly funny! Don't worry about burning the Fourth Amendment and abrogating your right to privacy, because the whole operation is so secret you won't ever know it happened!

So the mainstream media are disappearing the destruction of the Bill of Rights and Google News couldn't even find enough news about it to make the Top 50 stories this morning, but Barack Obama's plan to turn the Democratic National Convention into a political Super Bowl was all over the networks.

Only hours after Obama announced he would make his speech at the 76,000-seat Invesco Field at Mile High instead of the Pepsi Center, executives at ABC, CBS, NBC, CNN and Fox News Channel held a conference call to discuss how it affects their carefully considered plans to pool camera coverage of the event.

There it is! The absolute essence of corporate news in America! Forget about the destruction of the Bill of Rights and get those cameras ready for the humongous spectacle of the coronation of Brack Obama!

But however much Mr. Obama may have already won the nomination in his own mind, it all depends on non-binding expressions of preference by super-delegates, and it isn't absolutely impossible that those same super-delegates might suddenly discover a vestige of reverence for the Bill of Rights in their miserable souls, and insist on nominating a Democrat with real principles like Chris Dodd, instead of Barack Obama, no matter how much all the Obamabots in the peanut gallery might scream when the ring-master of their little circus was passed over.

Punishing them by forcing them to endure the cost and hassle of lawsuits would be counterproductive to securing such cooperation in the future, while offering little prospect of a useful outcome.

I disagree with the italicized part (if telecoms are ordered to comply in the future, they will comply), but the prospect of gaining anything timely and useful through lawsuits is remote. The President has the power to order investigations into illegal activity, and Obama has said that he will do just that. Obama's way is the better way.

While probably true, it's no defense, of course. Unless you believe in the Nuremberg defense. The 1978 FISA statute contained very specific provisions for certifications to be provided to telecoms by the government before commencing surveillance. And guess what -- if those procedures were followed, the telcos already have immunity under the 1978 FISA law. Which means that there's no need for changes to the law, and no need for the immunity that Bush and Cheney are so desperately seeking.

The fact that they're pushing so hard for immunity in the new bill means that they did break the law.

And that's exactly what Judge Walker ruled, in July 2006, when he DENIED the telcos' motion to dismiss the class action case:

Moreover, because "the very action in question has previously been held unlawful," AT&T cannot seriously contend that a reasonable entity in its position could have believed that the alleged domestic dragnet was legal.

Just when I was about to give up on TPMCafe, several excellent comments appear apparently out of nowhere, a hostile exchange gets resolved with mutual respect, and a couple of Obama's friends make substantive arguments instead of... something else.

This is how the liberal blogosphere is supposed to function, IMHO. Sometimes, like now, it feels like an infinitely flexible version of those college seminars that most of us were too dumb to appreciate the first time around.

I don't see anything silly about recognizing when someone starts talkig about security is the reason to capitulate on core values. That's very Bush.

I find it ironic when people who never bothered to read Obama's book or do any research on his actual positions and record think this "violates his core values" when those of us who have done all those things don't think it is a departure for him at all. Why is that?

Obamabots must be getting totally desperate when the only way they can defend their hypocritical candidate is by trying to censor somebody's avatar.

I painted the large version of that avatar myself, and it's supposed to suggest the unspeakable craziness of the genocide in Rwanda, triggered by a radio announcement about "chopping the tall trees," meaning "kill the Tutsis." That's why I called it "Announcer (Rwanda)," and I thought it would be obvious enough for even a moderately intelligent sixth-grader to understand, if he or she looked up Rwanda on Wikepedia.

But now that I find out Obamabots can't understand it, maybe I can make it a little simpler, so I'm changing the title to "Radio (Rwanda)," and maybe it's simple enough for a typical Obamabot to understand...

But I have to admit that Obama knows his audience better than I do, and "Yes We Can" is probably the most complicated concept that any of them will ever comprehend.

I guess TPMers have perfected the reverse troll by flooding posts with troll-baiting. Now all of this bashing can't be only because the poster supports Dodd over Obama, can it?

This post is closer to mainstream Democrats and progressives than any of the "Shhhh! Don't openly talk about government crimes and infringements, it may hurt our candidate" posts. What about comments that defend Obama at any price and will justify almost anything? What about the misinformation spread here about what the FAA really does, which this post is trying to correct? What about those who are now oh so very concerned about unbridled surveillance to fight off the imminent terrist attack? Or those concerned about punishing the telecoms just for being patriotic? What about holding Obama above any and all criticism? Any trolling there?

Almost all the discussion of Obama's swing to the right is divided between fanatical defense and "I told you so!" from Hillary's friends, but there's also something going on here that doesn't reduce to these simple alternatives.

Why was Obama so sudden about all this shifting? He could have dragged it out and still covered his butt with independents, if that's what he's doing, without totally enraging a lot of his base.

I don't understand a lot about the timing, and some of the details about NAFTA, for example. This was a subject he could have left for later, but he just piled on one shift after another.

Why?

I'm not looking for an answer like "Because he's just a big liar!" or "None of it happened!" or whatever one side or the other automatically says.

But there's something strange about the whole process, and if the liberal blogosphere could really function as a forum for honest discussion for about one day, instead of being just another wall for posterization by one side or the other, maybe we could put together enough info and insight to figure it out.

I agree. Something stinks on Capitol Hill. I've thought this for some time, especially during some of the revelations and "investigations" such as the discovery that torture session video tapes were destroyed (almost every congressional investigation has been stalled without any real backlash). Leadership in both Houses pulls back on pressing these matters.

It was odd enough that, when running to get majority control of Congress, they basically sabotaged the plank they were running on. Running on ending the war and abuses by the Bush administration, Pelosi declared impeachment off the table while Reid and others claimed de-funding equated to abandoning our troops in the field. They hamstrung their own ability to make the changes they were elected to make.

I may be wearing my tin foil hat here, but if this was not a purposeful dodge, they have certainly gone out of their way to dodge doing anything in every other way. The spinelessness only seems to come up when it involves cahngin and challenging the status quo, government abuses and failed programs. But take something like steroid use in baseball (shock, shocked I tell you) and all of a sudden, congress is a bulldog.

When you allow Obama to insult your intelligence by claiming that the bill "re-establishes basic judicial oversight" when it plainly does not, you are drinking the Kool-Aid.

When you allow Obama to insult your intelligence by claiming that the bill contains "important tool[s] in the fight against terrorism" without asking which of those "important tools" were unavailable under the 1978 FISA law, you are drinking the Kool-Aid.

When you fail to wonder about Obama's, um, let's call it "strategic reversal" -- of today voting for cloture (i.e. against a filibuster) of a bill that unequivocally did contain retroactive immunity for telecommunications companies, when last October his campaign spokesman, Bill Burton, said: ""To be clear: Barack will support a filibuster of any bill that includes retroactive immunity for telecommunications companies," then you're drinking the Kool-Aid.

When you attack Greg and Eric merely for recounting the history of Obama's positions on this issue -- when you decide that telling the truth is tantamount to treason against the Democratic Party, or when you claim that the only real purpose of this board is helping Obama get elected, then you're drinking the Kool-Aid.

When you post that "Even Senator Feingold praises parts of the bill" while ignoring the vast bulk of his discussion, which is pointed, detailed and justified criticism, then you're drinking the Kool-Aid.

When you post outright lies about Obama's history and then when called on it with obvious facts and references, your only response is "Blow me, shithead", then you're drinking the Kool-Aid. (As Tankard wrote in that thread, sometimes the jokes just write themselves.)

And you know, deep in your heart, although you never will admit it, certainly not to me, not to us, and likely not to yourself, that the only reason you are taking the positions you do on this bill is that Obama also took those positions. Most doctors that I know have about as much liberal education as plumbers, and it's refreshing to encounter a brilliant exception.
