California Supreme Court Overturns Gay Marriage Ban

In a surprising 4-3 vote... the California Supreme Court has ruled that domestic partnerships do not meet the constitutional requirement for a substitute for marriage rights for California's gay and lesbian couples.

As a progressive gay man, I am overwhelmed by this development.  I am worried that it will become a November issue and a scare tactic for the GOP... but it's a huge step to equality for all.

This actually helps as it shoots holes in the argument that civil unions are "just as good" as marriage for gay couples.

You should bookmark this and drag it out to bludgeon anyone who says so.

It is also important to note that of the 7 Justices who sit on the California SUpreme Court...

6 of them were appointed by Republicans.

Only 1 was appointed by a Democrat.


Tolerance is Bipartisan!

this could motivate the wingnut base to get up and out for John McCain. its probably the only thing that could. They really don't like him, but they hate the idea that i might be able to marry the man i love someday.

couldnt they have waited till after november to announce this?

i mean...this is just bad timing. Gay marriage in an election year= trouble.

To hell with "tolerance". I can "tolerate" a bad smell.

Love and (equal) marriage are something to celebrate, not tolerate.
But hey, if equality is bipartisan -- fight on!

The good thing about equal marriage is, once the voters realize that the sky doesn't fall, they get on board with it. See, e.g. Massachusetts, Spain, South Africa, the Netherlands, Canada. (But see, sadly, Hawaii in the '90s.)

CA is always viewed as the kooky liberal state anyway.

So liberal that it produced the following 2 US Presidents:

Richard M. Nixon
Ronald W. Reagan

It's about time, California!

Somewhere in Pennsylvania, that big vein in Rick "Man on Dog" Santorum's forehead is about to burst.

Since almost every other state has gay marriage 'bans', there is nothing on the national ballots to 'bring them out' this time.

And since California voters voted TWICE to legalize gay marriage - I don;t see the problem.

And the fact that SIX of the SEVEN justices are REPUBLICAN

Let's see if the sky falls tomorrow like the wing-nuts said it will.

...I would say that we have nothing to worry about on that front.

Better late than ever. Irony something so fundemental took so long.

Gonna be a HUGE issue in CA in November and a HUGE headache for the Republicans

The hard right will have a ballot initiative in November. Arnold opposes it.

McSame will have to take a stand
It will be defeated
