Freedom's Watch and the West Wing

My wife and I are re-watching season 1 of The West Wing during Spring Break. In episode 11, "Lord John Marbury," Josh Lyman is subpoenaed by a wing-nut group called Freedom Watch. I swear this is true, it's in the first 5 minutes of the episode after the opening title music if you want to check it out.
My question is- did Ari Fleischer (or whoever the "brains" behind the outfits is) straight up plagiarize from Aaron Sorkin? Or is there some big difference between Freedom's Watch (Fleischer) and Freedom Watch (Sorkin). Because it seems to me there's been some artistic poaching here: a real certifiable wing-nut group taking the name of a fake certifiable wing-nut group. 
Gosh, they don't even try that hard, do they?

BTW- Their ad banners suck!

The West Wing "Freedom Watch" is a fictional named analogy to Judicial Watch. There is nothing anyone should be sued over in the naming.
