Judge delays setting trial in Clinton fraud case
But accuser begins seeking sworn testimony from high-profile witnesses

A judge in Los Angeles yesterday allowed Hollywood mogul Peter F. Paul to begin taking sworn testimony in his $17 million fraud suit against former President Bill Clinton, but a technicality delayed establishment of a trial date.


California Superior Court Judge Aurelio N. Munoz ruled Paul's legal team can begin seeking depositions from a host of big names – including Bill, Hillary and Chelsea Clinton – that allegedly were witnesses to an effort by the Clintons and top Democratic leaders to extract millions of dollars from Paul in illegal donations and then cover it up.


Munoz is expected to set the trial date at an April 25 hearing. He said yesterday in court he could not set the date, because defendant Jim Levin, an aide to President Clinton, must be served notice again. Levin did not respond to the original complaint, and Paul's legal counsel at the time – the Washington watchdog Judicial Watch – did not file a notice of default to verify that fact before filing an amended complaint.


The complaint says Bill Clinton promised to promote Paul's Internet entertainment company, Stan Lee Media, in exchange for stock, cash options and massive contributions to his wife's 2000 Senate campaign. Paul contends he was directed by the Clintons and Democratic Party leaders to produce, pay for and then join them in lying about footing the bill for an August 2000 Hollywood gala and fundraiser.


Paul attorney Colette Wilson told WND she has 30 days to service notice to Levin, and he will have 30 days to respond.

Levin is a key figure in the case, Wilson said, because he helped conceive the Hollywood event then contacted Paul to underwrite the costs. Paul claims Levin later was directed by President Clinton to sabotage Stan Lee Media by convincing Paul's Japanese partner – in violation of a confidentiality agreement – to incorporate a new company instead of investing another $5 million with Paul. The loss of that badly needed capital ultimately caused Stan Lee Media to fold, Paul maintains.


Wilson said she had a brief discussion yesterday with Hillary Clinton's lawyer, David Kendall, outside the courtroom and came away with the impression Kendall was not going to make it easy for Paul's team to depose the senator.


Paul said he is working on securing one of the country's top lawyers to lead the discovery process.


Kendall, who was traveling back to Washington yesterday, has not replied to a request for comment. Los Angeles-based Clinton co-counsel Jan Norman also did not reply.


Sen. Clinton was dismissed from the case as a defendant, but Munoz already has made it clear he won't accept any attempts to block Sen. Clinton from serving as a material witness.


In court April 7, 2006, a Paul attorney told Munoz he "anticipated opposition to taking the deposition of Senator Clinton. I assume we'll be back to court on motions of that."


The judge replied: "Well, any opposition is probably going to be dead on arrival, if that will – if you understand what I'm saying, Mr. Kendall."


Paul claims former Vice President Al Gore, former Democratic Party chairman Ed Rendell and Clinton presidential campaign chairman Terry McAuliffe also are among the people who can confirm Paul engaged in a deal with the president.


Paul contends his case will expose "the institutional culture of corruption embraced by the Clinton leadership of the Democratic Party," which seeks to attain "unaccountable power for the Clintons at the expense of the rule of law and respect for the constitutional processes of government."

As an Obama supporter who recently posted a blog entry about disingenuous Clinton trolls who pop up out of the blue, let me just say:

Peter Paul trash-talking about Clinton, coming from someone who has never posted on this site before, doesn't sit well with me either. Why don't you add something constructive to the conversation?

I don't just hate Clinton trolls, I hate all trolls.

I third. (I do note that this is not Potus's first post, but most of his/her posts are Clinton smears like this one.)

Allsburg, I'm with you on this one. And the source is World Net Daily. These guys are in the same disreputable league as Newsmax and Fox News.

We've got plenty of substantive disagreements with the Clinton campaign, its unnecessary to bring in the Right Wing Noise Machine to avoid talking about the War, the economy, etc.

This really is shameful.

Agree, a thoughtless post of an old article from the Republican playbook.

I'll go one further. Posting so much of an article, even from such a dubious source, is asking for trouble - not for the poster, for the site.

Links and pullquotes accomplish the same thing.

Here is where moderators really need to step in - many blog owners "amend" posts like this to reflect proper use of copyrighted material.

First of all, if notice has not been provided to all defendants, then they haven't even gotten to discovery. Normally, there is a motion by defendants which gives the defendant months to response. Then the judge may allow the case to be thrown out or go to discovery.

Wish there was a way to unrecommend something.

Wish there was a way to get Hillary supporters to defend Obama against racist smears in the same way Obama supporters are defending (rightfully) the Clintons in this thread.

The Clinton strategy is flawed in the most obvious way.

Sometimes its very difficult for people to see things clearly when its right in front of there face.

In todays world of the internet media many more people can filter through the spin of CNN and the likes of Fox News as was not the case in previous elections.

The Clinton's have always counted on deception as a proven tool to gather votes because it has worked for them to date.

The problem is people have been looking in the same drawer over and over expecting to finally find those missing car keys!

Finally people are realizing that doing the same thing over and over and expecting a different result is the problem we are in.

We will not be fooled again....NOT THIS TIME!

One more Obama supporter against this kind of trolling. (any kind for that matter)

Put me in the same category, Obama supporter who thinks this type of posting is bollocks. It adds NOTHING to true political discourse.

I guess it also shows that the right wing machine is gearing up for the fight no matter who wins the nomination!

First, Federal Rules of Civil Procedure apply. The case hasn't even gotten to discovery! First, after the plaintiff (Mr. Paul) provides Service of Notice to the court (not yet done), a hearing is held and/or motions filed to dismiss the claim before this ever gets to discovery. After the judge rules, even if it were to get to discovery, a year long process, then the defendant (Clinton) will file a motion for Summary Judgment which the plaintiff gets one shot to survive. If somehow plaintiff (Mr. Paul) survives SJ, it's late-2009 before a trial date is set. Pure BS.

If you look in Wikipedia you'll see that this is a very old suit that has gone nowhere. However, there's an account in the Washington Post that's entertaining as background material.

It looks like Potus crapped twice today. Given that there are no positive comments on this post or the other one (except by Potus), I think it's pretty clear that this person is recommending his or her own posts.

I too, while for Obama, repudiate vicious slurs and false reports.

I saw Peter Paul's video on this aaaages ago, and that, at least, provided absolutely no basis for his claims. Had a recording of Hillary congratulating a fundraising manager (not Paul) for unspecified good work, showed captions of legal papers, and had the managing prosecutor of the Clinton impeachment trial trash-talking Hillary.

I denounce, repudiate, reject, and say nasty things behind the back of Potus and his nasty fake-Obama-troll statements.

Trolly trolly troll.

Trolls suck. Let's get a flagging system up an running TPM. Or at least some kind of IP Address discovery. I'm sure that in the present case, it would reveal that Mr. Paul is behind this post.

The Game

We all love the team mentality. And we all love to be a part of the team. But being on that team we must make a choice. A choice which devides us and makes our team unique. A team we can identify with and support and nuture in good times and in bad times.

This is the American way. To stand up and voice our allegence. But in order to be for something that something must first be held to a standard and then held against all others as the better team, the right team the supreme team!

In doing so we must believe that only our team is true and righteous. But is it really? or have we played the game so long that we instinctively choose the red team or the blue team when the reality is we don't even know what our team stands for anymore than we understand the individuals in our own team! We all have been led to believe what our better angels know is wrong. Are we not all playing this game together on one team?

One vision......One goal...........One team?

Thanks, potus, for posting this. This case has been picked up by Judicial Watch, who have pursued so many legal cases against the Clintons since 1992.

Although right now it is in the right wing and tabloid press, I have a sinking feeling. It picks up many of the same threads we saw in Whitewater -- sweetheart business deals combined with campaign funding. I hope that it is without basis, but we'll see where it goes. It does look like Paul will have his day in court.

The comments on this post ratify the concern we should all have about the viability of what remains of our democracy. Well intentioned people express views they sincerely develop by consulting biased and manipulated media and ignoring facts on the public record that require the smallest amount of study, investigation and analysis.
The case of Paul v Clinton et al is the worst example of how ideology obscures reality that is plain for anyone who wants to see it to understand.
Hillary Clinton told the Washington Post, days after she participated in the biggest fundraising event of her life, that she accepted no money from Peter Paul, the man who sat with her the entire 6 hours of teh event. She told the Washington Post that Paul gave no money for this event (Event 39) and she told the Post through Howard Wolfson that she knew the event cost over $1million and was an in kind contribution.
In October, 2000, Feb and July 2001 she had her campaign report that Event 39 cost $380,000 and was a gift of Paul's public company, Stan Lee Media. In January 2005 her finance director was indicted by a federal grand jury on 3 counts of lying to the FEC for hiding the fact that Event 39 cost in excess of $1million. No one called Hillary or Wolfson as a witness to corroborate that they told the post they knew that Event 39 cost $over 41 million three months before the first false FEC report being blamed on the finance director.
The Dept of Justice Prosecutor, and the FBI agent who investigated - both said Peter Paul did give Hillary's campaign money- more than $1.2 million and it was hidden from the public by Hillary's campaign. In October,2005 Hillary's treasurer admitted hiding more than $700,000 of Paul's money and he was fined for doing what his subordinate was criminally charged with.
On January 30, 2006 Hillary caused a final FEC report to be filed which AGAIN hid Paul"s $1.2 million contribution- Hillary has never admitted she lied in the Post in 2000 to win her election and continues to hide the contribution the Justice Dept says Paul made- the BIGGEST contribution ever made to her campaign!
This isnt World Net Daily or NewsMax saying this - its the US JUstice Dept- and now Hillary will not be compelled to testify under oath about this in the Paul v Clinton case- UNTIL AFTER THE ELECTION according the a judge's ruling on Friday(www.paulvclinton.com) WAKE UP PEOPLE!
