  • Popular vote, schmopular vote. There's a reason that the Founding Fathers put so many bulwarks against democratic expression in the Constitution--they saw popular passion as incompatible with the considered deliberation that's necessary for effective governance.

    The way to change the process is for the DNC to assign percentages to various blocks of time before the convention, and then apply those percentages to the delegate counts that come out of the various primaries and caucuses. For example, if you hold your primary before Feb 1st you get 0% of your delegates. Feb 1st-Feb 14th might get you 20% of your delegates, 15th-29th gets you 40%, and so forth, with a max percentage of 120% after three months. (The percentages and schedule are completely off the top of my head). Maybe you have an extra-wide window at 100%.

    Each state can then decide how influential it wants to be at the convention vs. how influential it wants to be in the campaign.

  • The NH Secretary of State did not change the date of the 2008 primary until the MI Supreme Court ruled that the law setting the state's date to Jan 15th was constitutional. That was on 21 Nov 2007:

    NH, IA, and SC received waivers for their revised dates from the DNC on 1 Dec 2007, the same day that MI and FL were stripped of their delegates (as those states had been warned would happen):

    In no way did the First Four states violate DNC rules.

  • Under Rule 11.A., five states were in violation of the Democratic National Committee's Delegate Selection Rules, and as such, all five states should have been punished under Rule 20.C.1.a.

    Rule 20.C.5 stipulates that the DNC may take further action against any state party which is found to be in violation of the rules:

    "Nothing in the preceding subsections of this rule shall be construed to prevent the
    DNC Rules and Bylaws Committee from imposing additional sanctions,
    including, without limitation, those specified in subsection (6) of this section C.,
    against a state party and against the delegation from the state which is subject to
    the provisions of any of subsections (1) through (3) of this section C., including,
    without limitation, establishing a committee to propose and implement a process
    which will result in the selection of a delegation from the affected state which
    shall (i) be broadly representative, (ii) reflect the state’s division of presidential
    preference and uncommitted status and (iii) involve as broad participation as is
    practicable under the circumstances."
