Alito's Prep for the Hearings
Some have questioned the propriety of Senator Graham participating in the so-called murder boards (the mock hearing sessions) for Alito, but Senator Feingold just raised an interesting series of questions. The transcript's not out yet, but this is the nub of it:
Did Administration officials participate in your murder boards, did the question of the limits (or lack thereof) on Executive power come up especially as regards the NSA wiretapping American citizens at home, and to what extent did Administration officials advise you on how to answer those questions?
Alito basically said that Administration officials did not tell him how to answer questions. This area is ripe for follow up later tonight or tomorrow, but it raises some fascinating and troubling issues, no?
How credible is it that Alito, after spending hours and hours being prepped by senior White House and Justice Department officials, was never given counsel on how to answer (or avoid answering) questions about an issue of such import to the Administration?
Ok, so no one ever told him what to say. Instead, did they ask him whether he could comfortably say it another way -- a way they like a lot better? I know everyone is shocked -- shocked -- that such might take place, but given the stakes on both sides here this is pretty hard to swallow.
Please, please tell the Senate judiciary committee staffers to tell their bosses to pursue this line of questioning. It would work for other areas as well, and it's much harder for the nominee to avoid answering and much easier for the questioner to pursue (unfortunately, beyond simply not answering direct questions directly, it's just too easy for the nominee to lose the Senators in the Constitutional woods). If Alito comes across looking like he's willing to change his views just for confirmation to (probably poll-tested and focus-grouped) formulations spoon-fed to him by the Bush Administration, how can Senate Dems possibly support him?

Opponents need to stay focused on the long term impact, Alito's judicial philosophy. Murder boards are a tangential subject and beyond the reach of the opposition anyway.
Let's get back to judicial philosophy questions and analysis. I want Q&A on his views on checks and balances, role of each branch of government, and the role of the SC relative to the other two.

This refusal to answer questions on "issues" that might come before the court is pure invention. A judge can't answer questions on CASES that might come before the court. A Senator from Washington can't ask, "If we confirm you, how will you vote on that Microsoft anti-trust case that's pending on the docket?" That's improper - the nominee would have to say, "I really can't answer that, Senator.". But a judge can answer general questions of principle regardless of whether they might come before the court, as long as there is no actual case pending. This business of refusing to do so on ethical grounds is horseshit.

The argument that a court nominee can't answer questions about his or her opinions on major cases of the day that could come before the court has always seemed absurd to me. Anyone who is qualified to be a Supreme Court nominee surely must be someone who knows the law thoroughly and has well-considered opinions about it. Those opinions exist whether the judge states them publically or not. Hiding them from the public doesn't make any bias in the judge's opinions go away--it just makes the bias unknown. I don't see why a hidden bias is better than an overt one.
The argument gets even more absurd when the judge has published opinions about major legal issues in the past. If the judge won't discuss whether his current opinions are the same or different from his published opinions, why shouldn't we assume the published opinions continue to be the opinions he or she holds? If we're so worried about opinions expressed in a Senate hearing biasing a case, why aren't we equally concerned with past published opinions doing the same?
And finally, aren't judges supposed to consider the merits of the case and the arguments presented regardless of their own opinions? If we are so afraid that a particular judge's opinions might bias that judge's decisions, then maybe we should nominate a more open-minded candidate.

Halliburton and like companies being used as a de facto marhasll law exstension. They will be able to go around posse comitatus and become part of the Katrina scenarios.
The contractors who shot people in New Orleans off the bridge at ponchratrain are an example. These people were not named or charged or investigated. Carte blanche authority to shoot first and ask questions later.
The fact those might have been Asia theatre veterans from mercenary nations went unchallenged. Alito is trying to establish that ability as an everyday circumstance. The mitigating factor is simply the whim of the Chioef Executive.
Alito is a walking enabling act.

Look, the best case we have against the right wing is corruption and Bush admin miselading us on Iraq, and Alito gives us a great entre.
He said he would recuse himself, but when his dollar values were in conflict with his stated judical values, his dollar values won. Is this any different from Jack Abramhoff et al ignroing the laws on lobbiests?
And, Alito has admitted he told the Reagan administration what they wanted to hear to get a job, is this any different from the Bush admin saying Iraq woudl be cheap, easy, and quick in order to justiy a lame invasion of Iraq?
We have a wonderful opportunity to tie Alito to the GOP corruption and the Bush admin lies. Let's take it.
Last ngiht's (tues) Countdown said the right was hoping that the Alito hearings might distract from the Bush admin and GOP failures. Let's tie it all it.
It you are a right winger, you are probably unethical (tell them what you want to hear) and corrupt (ignore your promises if your financial well being is in doubt).
Can't we use this golden opportunity?

I guess we will have to retire the justices after 20 or 30 cases and the Senate will do hearings for candidates full time in the future...

You're absolutely right zumbrunndbla. Any judge who's ever issued an opinion on an issue might have to recuse himself/herself if the issue ever comes before his/her court again. Supreme Court justices would get just one shot at an issue and then they'd have to remain silent in order not to create any perception of bias . . .
It's totally absurd.

jc points out that Alito says as a government attorney he was just advocating for his client.

If Democrats think they are going to sabotage this nomination, I can guarantee you President Bush is going to nominate someone who will cause liberals mass cardiac arrest: Janice Rodgers Brown, and we WILL go to war over that if it happens.
Justice Alito will be confirmed to the SCOTUS. Kennedy, Frankenfeinstein, Durbin, and Schmuck Schumer are going to vote Against him, no matter what Alito says, no matter what Alito does. Period. I wish to God, Alito had the guts to sit there and say, "gentleman, Roe is a piece of garbage of law, that I intend to do my best to overturn, and return it to the States where the killing of unborn children can be properly addressed by its citizens."
But he won't say that. This is the reason why we voted for the President. Because he is tough on terror, and because we must straighten out the abomination of the Supreme Court.
You should have heard the Michael Savage show tonight. He played a tape of Ruth Bader Ginsburg "answering" questions. Evasions, half-answers and the like. Then, the infamous, "Gentlemen, no hints, no previews, no forecasts."
Welcome Justice Alito, not a moment too soon.

Isn't it also horseshit for anyone qualified to be a Supreme Court justice to sit still for a bunch of political operatives drilling him on what to say to the Senate? How could anyone with any of integrity accept that?
